Description: 1839 RARE ORIGINAL Letter from Rufus Choate, a famed trial attorney, U.S. Senator and Congressman, to Emory Washburn Boston Massachusetts Attorney and later Governor of Massachusetts who served in the militia during the Civil War a. The letter involves a request for more time for a court hearing due to delays caused by the Barnes v. Boston Worcester Railroad case, which was a notable case for one of the first personal injury cases by an employee against a corporation. Choate was known for his messy handwriting, which is evident here. As best I can make it out, it reads: "Boston Mar.12, 1839, Emory Washburn, Esq., My dear sir, Owing to the great pressure upon the counsel engaged in the case of Barnes v. the B.W. Railroad Corporation, we find that we shall be unable to proceed through the hearing next week & we propose, if agreeable to you, that the evidence shall be completed on Monday & the argument postponed until some ...day when the counsel can be prepared. But if, by reason of your d...for us, it will be inconvenient to you to attend twice, we will then postpone all...hearing , if you ...until the for it ican. We will thak you to firm us early of your news. Very truly, cofling? R. Choate [reverse] P.S. We are very serious that you should come on Monday and finish the evidence if not inconvenient."
